OFFICIAL RULES The following Giveaway is intended for participation only by persons 18 years of age or older in the United States and shall be construed and interpreted according to the laws of Colorado and the United States. Please do not register unless you are a legal resident of the United States and 18 years of age or older.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS GIVEAWAY.
A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. Giveaway is open only to legal residents of the 50 United States and the District of Columbia. Void in Puerto Rico and where prohibited or restricted by law. Giveaway starts on 9:40 a.m. MST May 19, 2005 and ends on 11:59 p.m., MST August 31, 2005 ("Promotional Period"). Subject to all federal, state and local laws and regulations. These are the official rules and no other rules can or will apply.
ENTRY. To enter, access the web site of First and Main Town Center (the “Sponsor”) at
www.firstandmaintowncenter.combetween 9:40 a.m. MST on 5/19/05 and 11:59 p.m. MST on 8/31/05 and complete the online entry form to register for the Giveaway. All participants must have a valid e-mail address. By entering, entrant agrees to these Official Rules.
Limit one (1) entry per person. Each entrant must have their own e-mail address. In case of dispute as to identity of the winner who enters, entry will be declared made by the registered user (meeting eligibility criteria) of the e-mail account, and if a prize is won, it will be awarded to that registered user. Sponsor is not responsible for any change to e-mail address, mailing address and/or telephone number of participants. Sponsor is not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or other technical failures, unauthorized human intervention, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information online regardless of cause. Once submitted, entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any use of robotic, script, macro or other automated means, programmed or like entry methods will void all entries affected by such methods and be deemed tampering. Noncompliance with any entry procedure will result in disqualification.
By entering this giveaway, entrant acknowledges and understands that the name and other information provided may be used as part of a mailing list and database for the purpose of promotion and marketing activities by First & Main Town Center and all the merchants at First & Main Town Center.
PRIZE/APPROXIMATE RETAIL VALUE (ARV), ODDS OF WINNING CONSUMER DISCLOSURE.
Grand Prize - One (1) entrant will win all items listed as the Grand Prize on the website www.firstandmaintowncenter.com. Value ranges between $800 and $2,000 based on availability of donations from First & Main merchants.
June, July & August Prizes – Approximately five (5) to twenty (20) entrants will be selected to win a prize pack in each month of June, July and August. Prizes consists of two (2) prizes from First & Main Town Center Stores based on availability of donations from First & Main merchants. Value ranges between $40 and $100.
If winner cannot accept the prize due to schedule conflict or any other reason, prize will be forfeited in its entirety and Sponsor reserves the right to select an alternate winner.
Odds of winning a prize depend on the total number of eligible entries received. All taxes, fees and surcharges on prizes are the sole responsibility of the winner. No cash redemption.
Prize is non-transferable, cannot be assigned and must be accepted as awarded; Sponsor may substitute a prize of equal or greater value if selected prize, or any portion thereof, becomes unavailable for any reason. Limit one prize per household, family or organization. Therefore, if entrant wins a prize in either June, July or August, entrant is not eligible to win the Grand Prize. Unclaimed prizes may not be awarded.
DRAWING. Winners will be selected in a random drawing on or about the first day of July, August and September of 2005 from all eligible entries received. Nor’wood Development Group, whose decisions are final and binding in all respects, will conduct the drawing. By participating, entrants agree to abide by and be bound by the official rules and the decisions of the judges.
ELIGIBILITY. Open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older. Employees or agents of First & Main Town Center, Nor’wood Development Group and of participating First & Main Town Center Merchants, their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies involved in this promotion and members of the immediate family (parents, siblings, children & spouse) or those living in the same household (whether related or not) of such employees/agents are ineligible.
CONDITIONS OF PARTICIPATION. Winners will be notified by mail and/or e-mail and must respond within 21 days from date of notification, or prize will be forfeited. If a potential winner does not respond within 21 days an alternate entrant may be selected from all eligible entrants received. Grand Prize winner will be required to sign and return an Affidavit of Eligibility, a Publicity Release, and show proof of residency within 21 days of the date printed on the prize notification. If Grand Prize is won by an eligible minor, prize will be awarded to eligible minor's parent or legal guardian, who must sign and return all required documentation. In the event of noncompliance with these requirements (as applicable) or if prize notification/prize is returned as undeliverable, prize will be forfeited, and an alternate winner selected. Prizes will be shipped within 4-6 weeks of drawing date.
By participating, entrants release First & Main LLC and Nor’wood Development Group, their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, and the employees, officers, directors and agents of any of the above organizations from any and all liability for any injuries, losses or damages to person (including death and property damages) of any kind, caused in whole or in part, directly or indirectly by participation in the Giveaway, or the acceptance, possession or use/misuse of the prize or participation in any prize-related activities. Where legal, by accepting prize, winner agrees to the use of his/her name, address, likeness, photograph and/or voice and statements by winner (provided they are true) for advertising/publicity purposes without notice or further compensation. By entering, entrants agree that this Giveaway is governed by laws of the Colorado, without regard to conflicts of laws or principles, and all entrants hereby submit to the jurisdiction and venue of El Paso County, Colorado for the resolution of all claims and disputes.
Sponsor reserves the right, in its sole discretion, to cancel, suspend or modify the Giveaway should fraud, virus, bugs or other causes beyond the control of the Sponsor corrupt the administration, security or proper play of the Giveaway.
WINNER LISTS REQUESTS. For a name of the prize winners, send a self-addressed envelope by September 30, 2005 to: First & Main Town Center Summer Giveaway, c/o Nor’wood Development Group, 111 S. Tejon St. Ste. 222, Colorado Springs, CO 80903. Allow 4-6 weeks for delivery of winner’s list. The sponsor may also post a list of winner on its website located at www.firstandmaintowncenter.com.
